4. Privacy policy
4.1. General
4.1.1. This Privacy Policy regulates the processing of your personal data in connection with your use of our website (the "website") and the related services (collectively referred to as the "services"). This processing is carried out by Nubel vzw as the responsible controller, with registered offices at Victor Hortaplein 40 box 10, Brussels ("we", "us"), in accordance with the applicable legislation regarding the protection of personal data (GDPR)

We reserve the right to modify the Privacy Policy regularly in accordance with our own understanding. Such a modification will be communicated via the website.

4.2. What data we process & why?
When you use our website and / or our Nubel Foodplanner, we process your personal data for the following reason:
4.2.1. Nubel vzw collects and processes customer’s personal data for customer and order management (including customer administration, order / delivery tracking, invoicing and marketing and personalised advertising).
4.2.2. Nubel vzw collects and processes the personal data of users of our websites and online services at the following web addresses:

In principle, we obtain the abovementioned personal data directly from you and these are necessary for the proper functioning of the websites, ordering formalities and online applications on www.nubel.com, www.nubel.be, planner.nubel.be and www.internubel.be.
In addition to the aforementioned purposes, we can also process your personal data:
a. To provide you with personalised and effective information on the products and services you request, whether via the website, by email, by phone or social networks.
b. To process your personal data so that we can provide the services.
c. For direct marketing purposes, that is, to provide you with targeted communications, promotions, offers, and other advertising from us or our selected partners. For this, we will ask for your prior authorisation.

4.3.4. Processing children’s personal data:
Nubel vzw will not collect or process personal data of children of 16 years of age or younger ("Child") without parental consent, in accordance with the applicable local legislation. If we become aware that a child's personal data has been unintentionally collected, we will delete that data without undue delay.
4.3.5. The processing of sensitive data:
In certain cases, we may process special categories of personal data about you ("sensitive data"). Sensitive data include personal data on racial or ethnic origin, political opinions, religious or philosophical views, trade union membership, genetic data, biometric data to unambiguously identify a natural person, health and sex life or the sexual orientation of a natural person.
We will only process your sensitive data if you have voluntarily given your prior, explicit and separate permission in a specific context for a specific purpose, such as when using the Nubel Foodplanner and the Foodplanner PRO.
4.4. Where do we process data?
We and our external processors will only process your identifiable personal data within the EEA.
4.5. How do we process data?
4.5.1. We will do our utmost to process only the personal data necessary to achieve the purposes stated in this Privacy Policy. We will treat your personal data in a lawful, fair and transparent manner. We will do our utmost to ensure that personal details are accurate and up-to-date.
4.5.2. Your personal data will be processed only as long as necessary to fulfil the purposes stated in this Privacy Policy or until you withdraw your consent to its processing. Please note that withdrawal of consent may imply that you are no longer able to use the website and / or services in whole or in part.
4.5.3. We will take appropriate technical and organisational measures to protect your personal data from unauthorised access or theft and from unintentional loss, manipulation or destruction. Access by our personnel or the staff of our external processors is only possible on a need-to-know basis and is subject to strict confidentiality obligations. However, you understand that providing safety and security are only best efforts obligations that can never be guaranteed.
4.6. Your rights
4.6.1. You have the right to request access and view your personal data. Requests for access that are apparently submitted with a view to causing nuisance or damage to us, however, are not dealt with.
4.6.2. You have the right to request that any personal data about you that is inaccurate or incorrect be corrected free of charge. If such a request is submitted, you must also enclose proof that the personal data for which the correction is requested, is incorrect. If you are a user or administrator of the Nubel Foodplanner, you can correct many of these data yourself via your settings page.
4.6.3. You have the right to withdraw your authorisation previously given for the processing of your personal data. You can withdraw your consent at any time by sending an email to support@nubel.be or by deleting the profile (if you are an administrator).
4.6.4. You have the right to request that personal data relating to you be deleted, if it is no longer necessary in the light of the purposes set out in this Privacy Policy or if you withdraw your consent to its processing. You should, however, take into account that an application for deletion will be assessed by us in the light of legal or regulatory obligations or administrative or judicial orders that may prevent us from removing the personal data concerned.
4.6.5. Instead of deletion, you can also request that we limit the processing of your personal data if (a) you dispute the accuracy of such data, (b) the processing is unlawful or (c) the data is no longer required for the aforementioned purposes, but you need them to defend yourself in court proceedings.
4.6.6. You have the right to object to the processing of personal data if you can demonstrate that there are serious and justified reasons relating to special circumstances and justify such opposition.
4.6.7. When your personal data is processed on the basis of an authorisation or on the basis of a contract and the processing is automated, you have the right to receive the personal data you have provided us in a structured, generally used and machine-readable format and, if technically possible, you have the right to transmit this information directly to another service provider. The technical feasibility of this is evaluated exclusively by us.
4.6.8. If you wish to submit an application to exercise one or more of the above rights, you can send an email to support@nubel.be. This request must clearly state which right you wish to exercise and why. It must also be dated and signed and accompanied by a digitally scanned copy of your valid identity card that proves your identity. We will notify you immediately of receipt of this request. If the application is substantiated, we will comply as soon as is reasonably possible and no later than thirty (30) days after receipt of the request.
4.6.9. If you have a complaint about the processing of your personal data by us, you can always contact us via the email address support@nubel.be. If you are still not satisfied with our response, you can file a complaint with the competent data protection authority, the Belgian privacy commission.
